The meeting opened at 6:03 with Ms. Heaney acting as Chairman in Mr. Bouchard’s absence.

 

REHEARING:  GERALD BRADFORD/WILLIAM PHILPOT JR., ESQUIRE

The secretary read the application from the original hearing and then the list of abutters notified for this rehearing, as well as where it was advertised and stated that there were no telephone calls or written responses.  A request from Mr. Bradford was received asking to continue the rehearing to June 23, 2009 when a full Zoning Board would be available.

 

L. Onorato-Sullivan made a MOTION, second by A. Dolloff, to CONTINUE THE REHEARING FOR GERALD BRADFORD TO JUNE 23, 2009.  The motion CARRIED.

ZBA Minutes for 6/2/09

 

CONTINUED USE VARIANCE:  MARY E. WRIGHT/MICHAEL L. DONOVAN, ATTORNEY AND COUNSELOR AT LAW

Attorney Donovan asked to continue to June 23, 2009 when a full Board is expected, as well.  He submitted a corrected plan (correcting the scale).

 

L. Onorato-Sullivan made a MOTION, second by A. Dolloff, to CONTINUE THE USE VARIANCE FOR MARY E. WRIGHT TO JUNE 23, 2009.  The motion CARRIED.

 

CONFORMANCE OF THE AREA VARIANCE FOR MARY E. WRIGHT:

The secretary presented the Chairman with the required DOT approval.  Ms. Heaney stated that they also need DES approval and Ms. Wright agreed and said that she will send us a copy.  This will be continued as well.

 

REHEARING:  DAVID P. KENNEY, TRUSTEE/KENNEY FAMILY REVOCABLE TRUST OF 2002/MICHAEL F. CONKLIN, ATTORNEY AT LAW

The secretary read the application for the Use Variance, the list of abutters, where the hearing was advertised and stated that there were no telephone calls or written correspondence received.  After much discussion, Mr. Kenney asked to continue to July 7, 2009.

 

L. Onorato-Sullivan made a MOTION, second by A. Dolloff, TO CONTINUE THE REHEARING FOR DAVID P. KENNEY TO JULY 7, 2009.  The motion CARRIED.

 

USE VARIANCE:  JOSEPH MANCINI

The secretary read the application, the abutters notified, where the hearing was notified and stated that there were no telephone calls and there was one written letter.  Ms. Heaney read the letter from abutters Millie and Stu Rent.  The Rent’s object to the raising of the height of the building as it will obstruct the view of their four properties.  Mr. Mancini asked to see the photos that the Rent’s had enclosed and he felt that he does not want to create a problem.  Ms. Bonsteel explained that he would not need a Variance if he is to build in the exact footprint and height of the present building. 

 

At this time, Mr. Mancini asked to WITHDRAW HIS VARIANCE. 

 

MINUTES OF MAY 5, 2009:

The following amendments were made:  Page 3, 4th paragraph, 4th line, replace “DOT” with “DES”.  In the 5th line, following “they get” insert “DES and”.

 

L. Onorato-Sullivan made a motion, second by A. Dolloff, to approve the minutes as amended.  The motion carried.

CORRESPONDENCE:

The May 2009 Town & City magazine will be held in the office for any of the members to read.

 

NEXT MEETING:

The next meeting will be held June 23, 2009 with the Rehearing of the Bradford case and Mary Wright’s two variances.  The Board will meet with Town Attorney Bernie Waugh at 5:00 pm before the meeting.

 

With no other business, L. Onorato-Sullivan made a motion, second by A. Dolloff, to adjourn at 6:30 p.m.
